Terms of Service

These terms govern your use of this website and your purchase of Fortan Software from Flayr FX Limited, a company registered in Scotland (company number SC682689), registered office 15 Glenorchy Terrace, Edinburgh, EH9 2DQ. Your use of the Software itself is governed separately by our End User Licence Agreement.

1. Who you are buying from

Orders are processed by Paddle.com Market Limited, which acts as the merchant of record for this purchase. This means Paddle is the seller for the transaction, handles payment, and is responsible for charging and remitting any applicable sales tax or VAT. Your payment is made to Paddle, your receipt comes from Paddle, and Paddle's own terms and refund policy also apply to the transaction. We never see or store your card details.

2. What you are buying

You are buying a licence to a self-hosted software product, delivered as a download. It is not a subscription and not a hosted service. You install and run it on your own web hosting, and you are responsible for that hosting, for its cost, and for its suitability. Your licence includes a year of updates from the date of purchase; after that the Software keeps working, perpetually, on the versions you have — the EULA has the detail.

The technical requirements are published on this site — please check them before buying. There is no free trial; there is a live demo of the real application instead. If you are unsure whether it will run on your hosting, ask us at support@flayrfx.com before you buy. We would rather answer a question than process a refund.

3. Price and payment

The price is £149, charged once. Prices are as shown at the time of purchase. Depending on where you are, tax may be added at checkout or included in the displayed price; Paddle calculates this. Payment is taken in full at the time of purchase. Your licence key and download are issued automatically once payment is confirmed, normally within a few minutes.

4. Refunds and your right to cancel

4.1 If you are a consumer in the UK or EU

You normally have 14 days to cancel a purchase of digital content and receive a refund. However, that right is lost once the download begins, if you have expressly consented to immediate delivery and acknowledged that you lose the right to cancel. You will be asked to confirm this at checkout. If you have not yet downloaded the Software, you keep the full 14-day right to cancel for any reason.

4.2 Our refund policy

Beyond your statutory rights, we will refund you in full within 14 days of purchase if the Software does not work on hosting that meets the published requirements and we cannot resolve the problem with you.

We may decline a refund where the Software works as described and the request reflects a change of mind after download, or where we reasonably believe the request is not made in good faith.

To request a refund, contact support@flayrfx.com or use the contact form. Refunds are issued through Paddle to your original payment method.

5. Support

Support is provided by email at support@flayrfx.com, and through the licence holders' forum. We aim to respond within one working day. Support covers the Software working as described; it does not extend to configuring your web hosting, migrating data from other systems, or writing bespoke modifications.

6. Using this website

You agree not to:

• attempt to gain unauthorised access to any part of this site, its server or its database;
• use automated means to scrape, overload or disrupt it;
• post anything on the forum that is unlawful, defamatory, infringing, deliberately misleading, or that discloses another person's data;
• use the forum for advertising or solicitation.

We may remove any forum content and suspend forum access at our discretion. Doing so does not affect your licence — your software keeps working.

6.1 Content you post

You keep ownership of what you post. By posting you grant us a non-exclusive, worldwide, royalty-free licence to display, store and reproduce it on this site so that the forum can function and remain useful to others. You confirm that what you post is yours to post.

7. Availability

We aim to keep this website, the demo and the licence server available, but we do not guarantee uninterrupted access to any of them and we may withdraw or change them.

Importantly, none of this affects software you have already installed. Fortan Software runs entirely on your own server and continues to work whether or not our systems are reachable. There is no check that can switch off your installation.

8. Intellectual property

The Software, this website, its text, artwork and branding remain the property of Flayr FX Limited. Your rights in the Software are set out in the EULA. Nothing here transfers ownership.

9. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

Subject to that, and to the extent permitted by law:

• our total liability arising out of or in connection with your purchase is limited to the amount you paid for the licence;
• we are not liable for loss of profit, loss of business, loss of goodwill, or for loss or corruption of data;
• we are not liable for any failure or loss caused by your hosting environment, by your failure to keep backups, or by modifications you or a third party make to the Software.

10. Termination

We may terminate your licence if you materially breach the EULA — for example by redistributing the Software. Your licence otherwise does not expire.

11. Changes to these terms

We may update these terms. The version that applies to your purchase is the one published at the time you bought. Changes are not applied retrospectively.

12. Governing law

These terms are governed by the law of Scotland, and the courts of Scotland have exclusive jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country where you live, and any right you have to bring proceedings there.
